Welcome to The Grass Monkey Private Members Club (“TGM”, “we”, “us”, “our”). By accessing this website or applying for membership, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use our website or services.

1. PRIVATE MEMBERS CLUB STRUCTURE

1.1 The Grass Monkey operates as a Private Cannabis Association / Private Members Club in accordance with South Africa’s constitutional rights relating to the adult private use, possession, and cultivation of cannabis.

1.2 All cannabis-related activities take place strictly within the private domain of the club and its registered members.

1.3 No cannabis or cannabis-related products are sold to the public. Only verified members may request cultivation, processing, packaging, or allocation of cannabis through the club.

2. MEMBERSHIP REQUIREMENTS

2.1 To access the online menu, submit requests, or receive cannabis, members must:

  • Be 18 years of age or older

  • Create a valid membership account

  • Agree to all club rules, policies, and these Terms & Conditions

  • Confirm that all cannabis is for personal, private use only

2.2 TGM reserves the right to accept or decline any membership application at its sole discretion.

2.3 Membership is personal and non-transferable.

3. NATURE OF SERVICES (NO PUBLIC SALES)

3.1 The Grass Monkey does not sell cannabis. Members reimburse the club for costs related to:

  • Cultivation

  • Processing and trimming

  • Packaging

  • Operational and administrative services

  • Club infrastructure and facilities

3.2 Any amounts displayed on the website represent member reimbursements and are not commercial retail prices.

3.3 All cannabis remains within the private club network until allocated to a registered member.

3.4 Members may not resell, distribute, or supply cannabis obtained through the club.

4. USE OF THE WEBSITE

4.1 Access to restricted areas of the website is limited to registered members and may include:

  • The online menu

  • Product request pages

  • Member account information

4.2 Users may not:

  • Share menu items or member-only content publicly

  • Copy, reproduce, or redistribute TGM content

  • Use the website for unlawful purposes

  • Attempt to bypass age or membership verification systems

  • Interfere with website security or functionality

5. PRODUCT INFORMATION & AVAILABILITY

5.1 TGM makes reasonable efforts to ensure accuracy regarding:

  • Strain names

  • Potency ranges

  • Cultivation methods (Indoor, Greenhouse, Outdoor)

  • Weights and portions

  • Availability

5.2 Cannabis is a natural product; potency, flavour, aroma, and appearance may vary.

5.3 Availability is subject to cultivation cycles, curing periods, and member demand.

6. CONTRIBUTIONS, PAYMENTS & REIMBURSEMENTS

6.1 All payments made through the website represent member reimbursements, not purchases.

6.2 All amounts are displayed in South African Rand (ZAR) and include applicable membership service costs.

6.3 TGM reserves the right to adjust reimbursement amounts in response to operational or cultivation cost changes.

6.4 The club may refuse or cancel any transaction deemed suspicious or fraudulent.

7. ORDER PROCESSING & FULFILMENT

7.1 When a member submits a request:

  • Availability is confirmed by the club

  • The member completes reimbursement

  • Cannabis allocated to that member is prepared accordingly

7.2 Processing occurs during standard business hours.

7.3 TGM reserves the right to decline any request where:

  • Stock is unavailable

  • A compliance or safety concern arises

  • A member is in breach of club rules

8. COLLECTION & DELIVERY (PRIVATE DOMAIN ONLY)

In-Store Collection
Members must present valid identification, membership verification, and order confirmation upon collection.

Delivery
Deliveries occur strictly within the private network between the club and its members. TGM is not responsible for courier delays or damage occurring after dispatch. Risk transfers to the member once the package leaves club premises.

9. RETURNS, EXCHANGES & DEFECTIVE ITEMS

9.1 Cannabis products are not eligible for return due to hygiene, health, and legal considerations.

9.2 If a cannabis product is defective or incorrect, the member must report the issue within 48 hours, providing:

  • Order number

  • Clear photographic or video evidence

TGM will assess the claim and may replace the product at its discretion.

9.3 Accessories and merchandise (non-cannabis items) may be returned within 7 days, provided they are unused, sealed, and in original condition.

10. MEMBER RULES & RESPONSIBILITIES

Members must:

  • Use cannabis responsibly

  • Consume cannabis only in private, lawful settings

  • Not resell or share cannabis obtained through the club

  • Avoid conduct that brings the club into disrepute

  • Keep login credentials secure

  • Comply with all club rules, policies, and privacy requirements

Any violation may result in immediate suspension or termination of membership.

11. POPIA — PRIVACY & DATA PROTECTION

11.1 TGM complies with the Protection of Personal Information Act (POPIA).

11.2 Personal information is collected to:

  • Verify membership

  • Process reimbursements

  • Allocate cannabis

  • Communicate with members

  • Maintain legal and regulatory compliance

11.3 Personal data is not shared with third parties except essential service providers (such as couriers) operating within the private domain of service.

12. LIMITATION OF LIABILITY

12.1 TGM is not liable for:

  • Effects arising from cannabis consumption

  • Overuse, misuse, or allergic reactions

  • Loss or damage after products leave club custody

  • Delivery delays caused by third parties

  • Indirect, incidental, or consequential damages

12.2 Cannabis use is undertaken at the member’s own risk and discretion.

13. INTELLECTUAL PROPERTY

All website content, including branding, the TGM Monkey mascot, images, product names, layout, and artwork, is the exclusive property of The Grass Monkey. No content may be copied, reproduced, or used without prior written consent.

14. AMENDMENTS TO THESE TERMS

TGM may amend these Terms & Conditions at any time. Updates take effect once published on the website. Continued membership constitutes acceptance of the revised Terms.
